DIE VF PLUS IS DAAR OM TE HELP

 

Baie van u ervaar talle probleme met die e-tolstelsel. Vele mens kla dat hulle probleme ervaar terwyl hulle nooit eens op die e-tolpaaie gery het nie.

 
Die VF Plus is bereid om u te help om die probleme by die Nasionale Verbruikerskommissie (NVK) aan te meld. Die NVK het wye magte om te sorg dat SANRAL voldoen aan die Wet op Verbruikersbeskerming (die "Wet"). Talle van die probleme wat u ervaar is 'n blatante verbreking van die Wet, asook die Wet op Elektroniese Kommunikasie en Transaksies en die Wet op Belasting op Toegevoegde Waarde (onderstaande is nie 'n volledige lys van die probleme nie):

 
1. Aanmanings per sms en e-pos gestuur;
 
2. Aanmanings gestuur deur onwettig verkrygde databasisse;
 
3. Geen behoorlike rekeninge wat die oorhoofse hekkostes (soos gery) of BTW aandui nie;
 
4. Aanmanings en rekeninge aan persone wat nooit die paaie gebruik het nie;
 
5. Aanmanings en rekeninge aan persone wat nie oud genoeg is om te bestuur nie;
 
6. Aanmanings en rekeninge aan persone wat nie motors besit nie;
 
7. Die aanbieding van die getolde paaie as 'n ongevraagde produk en diens (vir diegene wat nie e-skyfies het nie);
 
8. Die dwing van gebruikers om e-skyfies aan te koop weens die substantiewe hoër pryse vir diegene wat nie registreer vir e-skyfies nie;
 
9. Verskille in pryse in die tariewe tussen die Afrikaanse en Engelse regulasies; en
 
10. Die dubbel-betaling vereis van diegene wat ander tuie sleep, soos woonwaens en sleepwaens.
 

Die NVK kan vereis dat al die probleme reggestel word. Terwyl u klag by die NVK hangende is mag SANRAL geen regstappe of enige ander stappe teen u neem nie. U hoef dus geensins SANRAL te betaal terwyl u saak aangehoor word nie. Hierbenewens gaan die VF Plus steeds voort met sy hofsaak teen die regering oor die E-Tolwet ten einde dit ongrondwetlik verklaar te kry. Indien ons wen, sal alle reeds betaalde gelde terugbetaalbaar wees.





THE FF PLUS IS THERE TO HELP YOU

 


Many South Africans are experiencing numerous problems with the E-Toll system.  Some people complain about being billed for using the E-Toll roads, even though they have never used these roads.


The FF Plus is willing to help you to lodge a complaint at the National Consumer Commission (NCC). The NCC has extensive powers to ensure that SANRAL comply with the Consumer Protection Act (the “Act”). Many of the problems that you are encountering is not only a blatant violation of the Act, but also a violation of the Electronic Communications Act and the Value Added Tax Act (the following is not a complete list of complaints):


1.    Demand notices send via SMS and/or e-mail;

2.    Issuing demand notices by means of illegally attained databases;

3.    Improper bills that do not reflect the overhead gantry costs (as used) or VAT;

4.    Issuing demand notices and bills to residents that have never used the E-tolled roads;

5.    Issuing demand notices and bills to persons that are too young to have a driver’s license;

6.    Issuing demand notices to people that does not own a motor vehicle;

7.    Presenting E-tolled roads as an unsolicited product and service (for those that do not purchase an e-tag)

8.    Forcing consumers to purchase e-tags on the premises that non e-tag users will pay substantial higher prices than e-tag users;

9.    English and Afrikaans regulations state different gantry rates; and 10.Double payment demands for road users towing trailers, caravans etc.

  
It is within the NCC’s power to demand that all irregularities should be rectified by SANRAL. While the NCC investigates your complaint, SANRAL may not take any legal action – or any other action of any sort – against you. In addition to this, the FF Plus will continue its court case against the government in regards with the E-Toll Act in a bid to declare it unconstitutional. If the court decides in our favor, all money paid to SANRAL must be refunded.

BELANGRIKE VERDERE ADVIES

 

1. Indien SANRAL of enige verkeersowerheid u steeds teister nadat u 'n klag by die NVK ingedien het, laai asseblief die aangehegte verweersbrief af en wys dit aan hulle. Hierdie brief bevestig u regte in terme van die Wet op Verbruikersbeskerming deurdat geen ander persoon of owerheid mag inmeng in 'n saak wat by die NVK ingedien is nie. Enige sodanige inmenging stel 'n misdaad daar.
 
2. Indien u gedreig word met arrestasie, kontak ons onmiddellik by 012 665 1679 ten einde u by te staan.



 
HANDVES VAN REGTE:

 
Onthou dat u die volgende regte het:

 
  1. U mag nie gedwing word om 'n e-skyfie te koop nie. E-skyfies is nie wetlik verpligtend nie;
  2. U mag nie gestop of gearresteer word indien u nie 'n e-skyfie besit nie 
  3. SANRAL mag nie rekeninge of aanmanings per sms of e-pos stuur nie.
  4. SANRAL mag nie rekeninge of aanmanings per sms of e-pos stuur verkry uit 'n databasis van 'n ander organisasie nie. U moes ondubbelsinnig ingestem het dat u inligting op die betrokke databasis aan SANRAL verskaf moes gewees het.
  5. SANRAL of enige owerheid mag u nie arresteer of verolg vir uitstaande tolgelde terwyl die Vryheidsfront Plus se hofsaak oor die grondwetlikheid van die E-Tolwet nog hangende is nie en u saak by die NVK dien nie. Indien u gedreig word met arrestasie, wys die verweersbrief aan die beampte of kontak ons onmiddellik by 012 665 1679 ten einde u by te staan.


 
WAT GAAN DIE VF PLUS DOEN?
 

  1. Soos voorheen genoem, gaan ons voort met die hofsaak oor die grondwetlikheid van die E-Tolwet; 
  2. Ons sal ook die volgende oorhoofse argumente by die NVK indien:

 
2.1 Dat die e-tolstelsel saam met die opgegradeerde paaie 'n ongevraagde produk is in terme van die Wet op Verbruikersbeskerming aangesien die paaie alreeds voorheen bestaan het en die publiek nie behoorlik gekonsulteer was alvorens dit opgegradeer is met 'n duur e-tolstelsel as instument van betaling as oogmerk;

 
2.2 Dat SANRAL moet voldoen an die spesifikasies van die Wet op Verbruikersbeskerming ten aansien van rekeninge;

 
2.3 Dat die tariefverskil tussen gewone en e-skyfie gebruikers buitensporig hoog is en 'n wyse is om mense te forseer om e-skyfies aan te skaf - 'n gebruik in stryd met die Wet;

 
2.4 Dat die tariewe moeilik vasstelbaar is aangesien dit bepaal word per oorhoofse e-tolhek en nie per kilometer gery nie.

FURTHER IMPORTANT ADVICE


1.    Should SANRAL or any traffic authority harass you after submitting a NCC complaint, you can download the attached Rights Letter and show it to them. This letter confirms your rights in terms of the Consumer Protection Act stating that no person or authority may interfere in a case that has been submitted to the NCC. Interfering in such a matter is a criminal offence.

BILL OF RIGHTS

 Remember your Rights:


  1.  No person or entity can force you to purchase an e-tag.
  2. You cannot be stopped or arrested for driving without an e-tag.  
  3. SANRAL is not allowed to send bills or demands via SMS or e-mail.
  4. SANRAL may not send SMS’s or e-mails using the contact details generated from other organisations’ databases unless you agreed unambiguously that your personal details/information on the said data basis may be provided to SANRAL.
  5. Neither SANRAL, nor any other authority is allowed to arrest or prosecute you for outstanding payments while the FF Plus’s court case, regarding the constitutionality of the E-toll Act, is still underway and the NCC is investigating your complaint.  Should you be threatened with arrest; show the official the Rights Letter or contact us immediately at 012 665 1679.

 

WHAT WILL THE FF PLUS DO? 

  1. As mentioned previously, the FF Plus will continue with the court case regarding the unconstitutionality of the E-toll Act.
  2.   We will also submit the following overarching complaints to the NCC:
 

2.1  That the upgraded roads and e-tolling system is an unsolicited product in terms of the Consumer Protection Act as the roads were already in existence (before the e-tolling was instituted) and that the public was not properly consulted before the upgrade making use of the e-toll system as expensive payment instrument. 

2.2  That SANRAL should adhere to the Consumer Protection Act in regards with consumer billing. 

2.3  That the excessive rate difference between ordinary users and e-tag users is a means to force the public to purchase e-tags – this practice is in contravention of the law. 

2.4  That it is difficult to determine the rates seeing that rates are determined by a valuation per overhead e-toll gantry and not according to the kilometers travelled.

FURTHER IMPORTANT ADVICE


1.  To submit a complaint to the NCC, please download the NCC complaint form by clicking on the NCC complaint form button. 

2.   Complete the form. Make sure to specify your particular e-tolling problem. Scan the completed form and email it to: This email address is being protected from spambots. You need JavaScript enabled to view it. or send it by fax to: 012 665 2420. 

3.   FF Plus will then submit the complaint to the NCC on your behalf.  

4.  The NCC will send you a reference number once they have received and processed your complaint.
